Privacy Policy

1. Introduction

Agent Studio is a product of ViAi Technologies Inc. ("ViAi Technologies," "we," "us," or "our"), a company incorporated in British Columbia, Canada. We are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website, platform, and related services (the "Service"), including when the Service processes information through third-party AI models and other third-party service providers.

2. Information we collect

We may collect: (a) account and profile information (e.g. name, email, password); (b) usage and product data (how you use the Service, logs, agent runs, performance and error data); (c) content you create, upload, or configure (prompts, agent configurations, files, and API keys you choose to store); (d) technical and device information (IP address, browser type, device identifiers, and similar diagnostic data); and (e) billing information, which is collected and processed by our payment provider. We may also receive information from third-party sign-in providers if you use them to log in.

3. How we use your information

We use the information we collect to provide, operate, secure, and improve the Service; to process transactions and send related communications; to respond to your requests and support inquiries; to send service, security, and legal notices; to detect, investigate, and prevent fraud, abuse, or security incidents; and to comply with legal obligations. We may use aggregated or de-identified data for analytics and product improvement. We do not sell your personal information.

4. AI processing and third-party model providers

To provide the Service, we send certain content you submit — such as prompts, configurations, and related context ("Processed Content") — to third-party large language model and AI infrastructure providers (for example, OpenAI, Anthropic, or Google) for processing and to generate output. These providers process Processed Content under their own terms and privacy practices, and may temporarily retain it for safety, abuse-monitoring, or legal-compliance purposes as required by their policies; we do not control those retention windows. We select providers that represent they do not use API-submitted content to train their own general-purpose models, but we cannot independently guarantee third-party practices and encourage you to review each provider's terms.

We do not use your Processed Content to train our own or third-party foundation models, and we do not sell it, without your consent. Because AI Output is generated by probabilistic models, it may be inaccurate or unpredictable; see our Terms of Service for details on the limitations of AI-generated output.

5. Sharing and disclosure

Beyond the AI model providers described above, we may share your information with: other service providers who assist us (hosting, storage, analytics, customer support, payment processing), subject to confidentiality and data-protection obligations; our affiliates; a successor entity in connection with a merger, acquisition, financing, or sale of assets; and as required by law, legal process, or to protect the rights, property, or safety of us, our users, or the public. We may disclose aggregated or de-identified information that cannot reasonably be used to identify you. We do not sell your personal information to third parties.

6. Data retention and security

We retain your information for as long as your account is active or as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. We implement reasonable technical and organizational measures designed to protect your data, including encryption in transit and access controls. However, no method of transmission or storage is completely secure, the Service and the third-party infrastructure it depends on may experience outages, errors, or security incidents, and we cannot and do not guarantee absolute security or uninterrupted availability. If we become aware of a security incident affecting your personal information, we will notify you and relevant authorities as required by applicable law.

7. Your rights and choices

Depending on where you live, you may have the right to access, correct, delete, or port your personal information, or to object to or restrict certain processing. Canadian residents have rights under applicable provincial and federal privacy laws (such as PIPEDA), and residents of other jurisdictions (such as the EEA, UK, or certain U.S. states) may have additional rights under their local laws. You can update your account details in settings, request access or deletion via our contact channel, or opt out of marketing emails using the unsubscribe link in those emails. We will respond to verifiable requests within the time required by applicable law.

8. Cookies and similar technologies

We use cookies and similar technologies to operate the Service, keep you signed in, remember your preferences, analyze usage, and improve security. You can control cookies through your browser settings; disabling certain cookies may prevent some features of the Service from working correctly.

9. International transfers

We are based in Canada, and your information may be processed in Canada, the United States, and other countries where we or our service providers (including AI model and infrastructure providers) operate. Data protection laws in those countries may differ from those in your jurisdiction. Where required, we rely on appropriate safeguards (such as standard contractual clauses or equivalent mechanisms) for such transfers.

10. Children

The Service requires users to be at least 18 years old (see our Terms of Service) and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected such information, please contact us so we can delete it.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the "Last updated" date, and where changes are material, we will provide additional notice (for example, by email or in-product notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.
